2. Hosting
The site empco-compliance.eu is hosted by Emergent Labs on Kubernetes infrastructure (data stored within the European Economic Area).
3. Intellectual property
All content (texts, trademarks, logos, databases, legal corpus, scoring algorithms, qualification methodology) is protected by the French Intellectual Property Code. Any reproduction, representation, modification, publication, transmission, distortion, in whole or in part, without prior written authorization is prohibited (articles L.335-2 and following of the CPI). Claims extracted from client sites remain the property of their authors.
4. Personal data — GDPR
In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, you have a right of access, rectification, erasure, opposition, restriction, portability and withdrawal of consent over your personal data. DPO contact: dpo@empco-compliance.eu. The register of subprocessors (Emergent Labs, Stripe, Resend, Anthropic) is available on request. Retention: account 5 years from last activity, invoices 10 years (French Commercial Code obligation). You can lodge a complaint with the CNIL (cnil.fr).
5. Cookies & trackers
Strictly necessary technical cookies (session, language preference, banner dismiss): exempt from consent (article 82, 1978 law). Google Analytics and Google Ads audience measurement cookies: subject to explicit consent through the CNIL/GDPR banner on first visit. You can change your choices anytime via the 'Cookie settings' link at the bottom of the page. Maximum consent retention: 13 months.
6. Liability
EmpCo provides a compliance assistance tool, not a legal opinion. The service constitutes a technical opinion based on EU Directive 2024/825, French law 2021-1104 (Climate and Resilience), the French Consumer Code and case law of the Court of Justice of the European Union (CJEU). It does not replace specialized legal counsel. The final decision to use, modify or withdraw an environmental claim belongs to the client. EmpCo cannot be held liable for administrative or judicial sanctions imposed on the client by the DGCCRF, the European Commission or any competent authority.
7. Applicable law & jurisdiction
These terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the Paris Judicial Court, after attempt at amicable resolution. European consumers: possibility to use the European online dispute resolution platform (ec.europa.eu/consumers/odr).
8. Accessibility
EmpCo commits to comply with the French RGAA 4.1 accessibility criteria. A full accessibility statement will be published before end of 2026 in accordance with EU Directive 2016/2102.
